1. Acceptance

2. Definitions
   For the removal of doubt, "Products and Services" is expressly defined to include, but is not limited to:
   1. Physical products purchased or otherwise obtained from Driveline Services Australia, either through this website or any other means of purchase available, such as by telephone or physical attendance at a location selling Driveline Services Australia products
   2. A service purchased or obtained from Driveline Services Australia, either through the website or other means of purchase noted above, including the installation of a product or other technical advice
   3. Other information provided on this website, including installation instructions, guidelines, product information and technical advice.
3. Conditions of use
   Use of the Products and Services is subject to compliance with these Terms and Conditions and acceptance that you acknowledge and agree that Driveline Services Australia may terminate your access to the website or to any of the Products and Services should you fail to comply with the Terms and Conditions published by Driveline Services Australia. Driveline Services Australia reserves the right to terminate any user’s access to this website or to any of the Products and Services for any conduct that Driveline Services Australia, in its sole discretion, believes violates any local, state, federal or foreign laws or regulations or conduct that may be directly or indirectly harmful to other users. Driveline Services Australia further reserves the right to terminate any user’s access to this website or the Products and Services for any reason or for no reason at all, in Driveline Services Australia’s sole discretion without any prior notice.
4. Age restriction
   The eCommerce section of this website is not available to persons under 17 years of age to purchase Products and Services without parental consent.
5. Parental controls
   In cases where you have authorised a minor to use the Products and Services, you accept that you are fully responsible for:
   1. the online conduct of the minor
   2. controlling the minor’s access to and use of the Products and Services
   3. the consequences of any misuse by the minor.
6. Privacy

In consideration of the use of the Products and Services and providing personal data, you represent and warrant that the information you provide is true, accurate and current. If you provide any information that is untrue, inaccurate or not current or if Driveline Services Australia has reasonable grounds to suspect you have provided untrue, inaccurate or not current information, Driveline Services Australia has the right to suspend or refuse any and all current and future use of the Products and Services.    Driveline Services Australia reserves the right to monitor some, all or no areas of the Products and Services for adherence to these Terms and Conditions. The Products and Services may only be used for the intended purpose for which they are being made available.
8. Prohibited conduct
   You agree that you will not use this website or the Products and Services to:
   1. Upload, post, email or otherwise transmit links to any content including, without limitation, the provision of instructions for illegal activities or that promotes illegal activity.
   2. Upload, post, email or otherwise transmit any content that exploits the images of children under 18 years or to disclose any personally identifying information belonging to children under 17 years of age.
   3. Make any sexual request on behalf of a minor or make any sexual request of a minor, stalk or otherwise harass another or harm minors in any other way.
   4. Collect or store personal identifying information about other users for commercial or unlawful purposes.
   5. Download, upload, post, email or otherwise transmit, or post links to any content or select any member, username or email address that is unlawful, threatening, abusive, harmful, harassing, defamatory, vulgar, obscene, pornographic, invasive of privacy or publicity rights, sexually, ethnically, racial, hateful or otherwise objectionable.
   6. Impersonate any person or entity, including but not limited to a Driveline Services Australia official, employee, forum moderator/leader or falsely state or otherwise misrepresent your affiliation with a person or entity.
   7. Argue with or disobey any Driveline Services Australia employee or representative or interfere with any action to redress any violation of these Terms and Conditions.
   8. Upload, post, email or otherwise transmit, or post links to any content that facilitates hacking, email harvesting or for spamming purposes.
   9. Conduct your own contest, raffle, promotions or advertising.
   10. Upload, post, email or otherwise transmit, or post links to any content that infringes on any patent, trademark, copyright or other proprietary right of any party, or contributing to inducing or facilitating such infringement.
   11. Upload, post, email, or otherwise transmit, or post links to any material including, but not limited to, any computer code, files or programmes that contains software viruses, trojan horses, worms, root kits, time bombs, trap doors or repetitive requests for information that are designed to interrupt, disable, destroy or limit the functionality of any computer software or hardware or to diminish the quality of, or impair the functionality of the Products and Services or the Driveline Services Australia website.
   12. Use automated programmes or files including, but not limited to, spiders, crawlers, robots, creepers, worms, scripts or the like to download any information from the Driveline Services Australia database.
   13. Disrupt the forum’s natural flow of dialogue or otherwise act in a manner that negatively impacts or affects other users’ ability to interact in the forum.
   14. Fail to complete any transaction after submitting an order to purchase any Products or Services from this website. By submitting an order to purchase Products or Services, you represent and warrant that you have the legal right and authority to make this purchase.
   You acknowledge and agree that Driveline Services Australia has the right (but not the obligation) in their sole discretion to refuse to publish, remove or block access to any content on this website, at any time, for any reason, with or without notice, that violates these Terms and Conditions. Driveline Services Australia may also terminate access to this website or any portion thereof for violating these Terms and Conditions.
   
   You acknowledge and agree that you must evaluate and accept all risks associated with the use of any content, including any reliance on the accuracy, completeness or usefulness of such content including, without limitation, information posted on the forums.
9. Licence to use content
   With respect to any content posted by on this website in connection with the Products and Services, you grant Driveline Services Australia a worldwide, royalty free, perpetual, license to use, copy, transmit, publicly display and to distribute such content elsewhere within the Driveline Services Australia website.
10. eCommerce
    You agree that Driveline Services Australia may change these Terms and Conditions at any time. You also agree that Driveline Services Australia may change the eCommerce facilities or remove this service at any time in our sole discretion for any or no reason with or without notifying you. You agree that if you continue to use our eCommerce facility after we have posted a change to this agreement, then you are bound by the most recent version of this agreement.
11. Dispute
    If you have a dispute with Driveline Services Australia about the Products or Services, please contact Driveline Services Australia via email in the first instance.
12. Disclaimer
    You expressly understand and agree that to the extent permitted by law, Driveline Services Australia disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, operability, or any damage including, but not limited to, injury to you or a third party or to a vehicle, part/s or tool/s, building, structure or injury, or death of any person and/or animal. All images that appear on this website are copyright to their respective owners. If you own the rights to any of the images and do not wish them to appear on this website, contact us and they will be removed.
13. Limitation of liability
    You expressly understand and agree that under no circumstances shall Driveline Services Australia be liable for the misuse of or incorrect installation of the Products and Services arising from the inability to use the Products and Services or from the interruption, suspension or termination of the Products and Services including such damages incurred by third parties. Such limitations of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary and punitive damages to the extent permitted by law.
    
    Under no circumstances shall Driveline Services Australia be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces or causes beyond its reasonable control including, but not limited to, internet failures, computer equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non performance of third parties or loss of or fluctuations in heat, light, or air conditioning.
14. Applicable law
    Driveline Services Australia is based in Brisbane, Queensland, Australia and as such these terms and conditions have been written to comply with all pertinent local, state and federal legislation as well as other relevant guidelines.
    
    It is understood that different regulations may apply in different jurisdictions both within Australia and overseas. Users in these jurisdictions should familiarise themselves with any such particular requirements to ensure their use of this website and the Products and Services is in keeping with such local regulation in their place of usage.
